Terms and Conditions

1. Trial Class

Clients are entitled to participate in a trial class and assessment at the cost RM35. However, a pool entrance fee per person is applicable and non-refundable, regardless of whether the client chooses to enroll or not. The pool entrance fee must be settled at the pool entrance upon arrival. Each trial class will consist of a group of up to 6 (six) individuals. Rest assured that the class will proceed as scheduled even if the slot is not fully booked.

2. Cancellation Policy

If you need to cancel your scheduled trial class, please ensure that you provide advance notice of at least 24 hours prior to your scheduled class. In the event of a cancellation, the class should be replaced by scheduling another session at a mutually convenient time. This policy is designed to allow for smooth scheduling and to accommodate the needs of all our coaches and students. In the event of a last-minute cancellation (less than 24 hours before the scheduled class), the class will be forfeited and there will strictly be no refund.

3. No-Show Policy

In the event of a no-show without prior notice, the class will be forfeited and there will strictly be no refund.

4. Coach Replacement

In cases where coaches are not available or unwell and are unable to conduct the class, ActiveSwim reserves the right to arrange and confirm a replacement coach without requiring confirmation from the student. We will promptly inform the student about the replacement coach.

If a replacement coach cannot be arranged due to unavailability during the scheduled class or if the student chooses not to proceed with the replacement coach, ActiveSwim retains the right to cancel the class. In such instances, arrangements will be made to reschedule the class, and the student will be duly informed of the arrangement.

5. Class Cancellations due to Force Majeure

We will make every effort not to cancel a lesson but the management reserves the right to alter the time of a lesson when necessary in the case of bad weather, unfit environment, timely pool maintenance or pool closure or any other unforeseen circumstance.

We shall give you as much notice as possible in a reasonable time of any such class cancellation and arrangements will be made to reschedule the class. 

We shall not be liable for any losses of any kind incurred by you as a result of such cancellation.

6. Other General Terms and Conditions of Service

1. Packages Available

Basic: RM1,200 for any one (1) stroke, with 6 months validity or maximum 24 lessons.

Intermediate: RM1,800 for any two (2) strokes, with 9 months validity or maximum 36 lessons.

Advanced: RM2,400 for all four (4) strokes, with 12 months validity or maximum 48 lessons.

The strokes above are the four (4) Olympic strokes of Breaststroke, Freestyle, Backstroke, Butterfly. Our recommended learning progress for our students is to start with Breaststroke, Freestyle, Backstroke and Butterfly in that order. 

The package price does not include the pool entrance fees. The pool entrance fee must be settled at the pool entrance upon arrival at the pool.

2. Package Validity

Upon enrolment and payment of the chosen package, you are acknowledging and agreeing on the expiration date of your package that is prominently displayed on both the invoice and the receipt for your reference.

If you successfully complete the program’s graduation requirements within any number of months within the validity period for the respective packages (i.e. 6 months, 9 months or 12 months), your package will conclude, and you may opt to renew with any package of your choice based on your preferences and can be based on the coach’s advice. 

If a) the validity period expires or b) the maximum number of lessons provided has concluded for the respective packages (whichever is earlier), regardless of whether you have completed the graduation requirements or not, the package will be deemed expired. In such cases, you will need to renew your package with one of our available options according to your preferences and can be based on the coach’s advice.

3. Class Format

The Guaranteed Program will be in a group learning format of up to 6 students to 1 instructor. Each class will be for a duration of one (1) hour only. 

The student shall attend the class on a weekly basis, unless the class is cancelled or arranged otherwise.

5. Graduation Assessment

To determine whether the student has graduated, the coaches will conduct assessments on a predetermined interval basis. The assessment will be on a set of criteria for each stroke that will be updated and shared with the students/guardians to ensure transparency and fairness. 

For Basic Package:

The 1st assessment will be conducted on the first 8th attended lesson for the stroke. If the student passes the assessment, then they will be considered graduates and the package will end. 

For Intermediate and Advanced Package:

The 1st assessment will be conducted on the first 8th attended lesson for the 1st stroke. If the student passes the assessment for the 1st stroke, then it will proceed to the next stroke and restart the cycle of 1st assessment on the 8th attended lesson for the 2nd stroke. 

If the student fails the first assessment on the 8th lesson, then there will be an assessment on every subsequent 4th lesson (i.e. 12th, 16th, 20th, …) until the student passes the assessment or the package expires (whichever is earlier).

6. Class Replacement Policy

The class will be on a fixed slot on a weekly basis. If you cannot attend due to any reasons, you may schedule a replacement class to any other slot, subject to availability. 

Any remaining uncompleted lessons need to be replaced before the expiry of the package validity.

8. Validity Freeze

The student may request to stop the classes and freeze the validity of the package, up to a period of 6 months, if there are any valid reasons (e.g. medical reasons to stop swimming temporarily) and we will remove the student from the slot. Thereafter, the student is required to rearrange with our admin to restart the classes.

If the student fails to restart the classes after the expiry of the 6 months’ freeze, the validity of the package will be considered expired.

9. Non-refundable & Non-transferable

There will strictly be no refund once payment has been made and the first class has started for our Guaranteed Program. 

The package will also be non-transferable to any other person. 

Please ensure you are certain to proceed with the Guaranteed Program before enrolling.

11. Waiver of Liability

Enrollment in the program constitutes an acceptance of the waiver of liability against ActiveSwim for any injuries or incidents occurring during program participation.
